Self-employment — our hardest file, your cheapest route

Self-employment7 min readReviewed: 2026-10-12

Ask any immigration adviser a simple question: "why don't you offer self-employment?" The answers are usually vague — it's difficult, they don't approve it, it takes too long. None of those is the real reason.

The real reason is that a self-employment file is the heaviest work an immigration firm can take on, and the same fee can be earned from a ready-made employment contract and a much thinner folder.

What the file actually requires

The legal basis is Ley Orgánica 4/2000 and the new immigration regulation, Royal Decree 1155/2024. What has to be built:

  • A real, defensible business plan — not a few generic pages, but something showing the investment, the market, and its effect on employment
  • A viability report from one of Spain's official self-employment bodies (ATA, UPTA, CIAE, OPA or UATAE)
  • Proof of your professional competence for that activity — qualifications, recognition of them, or documented experience
  • The licences the activity requires, and the status of each
  • A criminal record certificate and the supporting documents

Each of those means weeks of genuine work. Compare it with a route where an employment contract is signed and the file is closed. It becomes obvious why the market drifts the other way.

For you the arithmetic is reversed

Employer-based routes Self-employment
Manufactured documents Usually ends up necessary Not needed
Monthly cost after arrival A simulated salary and contributions must continue Only the real costs of your own business
Who owns the business The employer You
Renewal Depends on that relationship continuing 4 years after the first year
Risk at citizenship The original documents are re-examined Nothing to hide

The second row is the one that matters. On routes built around an employment relationship, the cost does not stop when the visa is issued — you have to keep the relationship alive month after month. With self-employment, the money you spend goes into your own business. It becomes an asset rather than the cost of maintaining an appearance.

And Spain is granting it more readily now

The new regulation made the route clearer and more predictable. The initial authorisation is issued for one year and the renewal for four, with more flexibility at that stage — including the ability to take employed work alongside your own activity.

For anyone planning to stay, that means no annual renewal treadmill after the first year.

Who this suits

Anyone with a skill or some capital they can build an activity around: a trade, commercial experience, a service, a small business. It does not have to be large. It has to be real.

If you are not sure your activity is defensible, ask us that question first. We will tell you whether your file has a chance before we take any money.

Why we do this work

Because the outcome is better for the client, and because a file built on reality does not come back years later to hurt them. The heavy lifting is ours.

Get in touch and describe your situation — we will tell you honestly whether self-employment works for you or another route fits better.
